Right to Access and Reuse Information

Under Article 3 of the Law on the Right to Access to Information (Official Gazette, Nos. 25/13 and 85/15), individuals and legal entities have the right to access and reuse information from public authorities. This right ensures transparency and public access to information about the activities of these authorities.

Conditions for reuse of information:

The public authority provides the user with data for unlimited reuse, for free use and in an open format.
In justified cases, the public authority can determine conditions for reuse. In the case of determining conditions for reuse, their content and application may not unreasonably limit the possibility of reuse, nor may they be used to restrict market competition.
The conditions for re-use of information must not be discriminatory for the same or similar types of information, i.e. for commercial or non-commercial use.
A public authority that reuses its information as a basis for commercial activities that do not fall within the scope of its public affairs is subject to the same conditions as for other users.
The types and content of permits that determine reuse, in accordance with standard open permits, are regulated by the ordinance of the minister responsible for administrative affairs.
The public authority is obliged to publish on its website the licenses that determine the conditions of reuse or links to such licenses in accordance with standard open licenses.

Information delivery costs are calculated according to the current price list of regular postal services.
Fee for access to information

Žnjan d.o.o. has the right to compensation for actual material costs arising from providing information to the user of the right to access and reuse information, as well as compensation for the costs of delivering the requested information, which is charged in accordance with the Criteria for determining the amount of compensation for real material costs and the costs of delivering information (hereinafter : Criterion) on the basis of Article 19, Paragraph 2 of the Act on the Right to Access to Information (Official Gazette, No. 25/13, 85/15).

The amount of compensation for actual material costs is determined in the following amount:

copy of one page in A4 size – HRK 0.25
copy of one page in A3 size - HRK 0.50
copy of one color page in A4 size - HRK 1.00
copy of one page in color in A3 size - HRK 1.60
electronic recording on one CD – HRK 4.00
electronic recording on one DVD – HRK 6.00
electronic record on the memory card depending on the amount of memory – HRK 210 for 64 GB, HRK 150 for 32 GB, HRK 120 for 16 GB, HRK 50 for 8 GB, HRK 30 for 4 GB.
converting one page of a document from physical to electronic form – HRK 0.80
converting a recording from a videotape, audiocassette or diskette into an electronic recording - HRK 1.00
Information delivery costs are calculated according to the current price list of regular postal services.

REMARK:

The amount of compensation for actual material costs for services that are not specified in the Criteria is determined by the public authority in such a way that the average market price for the service, the cost of depreciation incurred by the public authority and the cost of postal services are included in the amount of compensation. Information delivery costs are calculated according to the valid price list of postal services. The user of the right to information should deposit the expected amount of actual material costs in full in advance. In the event that the user of the right to information does not deposit the specified amount within the deadline, it will be considered that the user of the right to information has waived the request. Žnjan d.o.o. will issue the user of the right to information an invoice according to the amount of compensation specified in the Criterion.

Fee for reuse of information
Žnjan d.o.o. does not charge a fee for the reuse of information when it publishes information on official websites.

According to the Criteria for determining the amount of compensation for actual material costs and information delivery costs based on Article 19, Paragraph 2 of the Law on the Right to Access to Information ("Narodne novine", No. 25/13, 85/15), Žnjan d.o.o. may charge the user the actual material costs of re-using the information resulting from the reproduction, provision for use and delivery of the information, as well as if one of the following conditions is met:

the public authority is mostly financed from its own revenues or the user requests information, which the public authority provides adequate revenues to cover the costs of its collection, production, reproduction and publication,
the public authority determines the fee for re-use in accordance with the objective, clear and confidential criteria for calculating the costs of re-use of information established by the decree of the Government of the Republic of Croatia, and the costs are calculated in accordance with the accounting rules that apply to the respective public authorities,
the total annual revenue of the public authority realized on the basis of cost reimbursement does not exceed the costs of collecting, producing, reproducing and providing the information, including a reasonable return on investment.
